לא כתבתי כבר הרבה זמן וחשבתי לעדכן מעט על המתרחש בעולם המשפט הבינלאומי כיום.
הדבר הראשון שחשבתי להעלות הוא ההגדרה שנתן בית הדין המיוחד ללבנון (Special Tribunal for Lebanon) למונח טרור. לשכת הערעורים של בית הדין הציגה פסיקה תקדימית המציגה את ההגדרה של השופטים בבית הדין לטרור במשפט המנהגי הבינלאומי. הפסיקה מופיעה תחת הכותרת Interlocutory Decision on the Applicable Law: Terrorism, Conspiracy, Homicide, Perpetration, Cumulative Charging והיא נכתבה על ידי נשיא בית הדין Antonio Cassese בשם פאנל השופטים.
לשיטתם טרור מכיל את האלמנטים הבאים:
הבעיה עם ההגדרה הזאת היא שהיא רחבה מדי ויותר מדי ארגונים ממשלתיים ולא ממשלתיים יכולים להיכלל בה ושהיא פולשת לתחום הפעילות של U.N. Security Council Counter-Terrorism Committee .
העניין השני שרציתי להעלות הוא החיבור של Jack goldsmith מבלוג Lawfare שנתן קישור לחיבור שלו בנושא ההיתכנות של היווצרות אמנה ביטחונית בתחום ה Cyber. אחד הדברים המרתקים ביותר בתקופה הזאת היא העובדה שאנו יכולים להיות עדים לתהליך היווצרות של אמנה ביטחונית בתחום חדש יחסית. אפשר ללמוד המון מהדינאמיקה שבין המדינות המעורבות בעניין ומהתהליכים וההצעות שעולות. בכל מקרה, מאוד מומלץ אפילו כרקע לתחום ולאמנה המתגבשת (אם בכלל – ע"פ המאמר).
הדבר השלישי שחשבתי לקשר אליו הוא מאמר נחמד בנושא ההסתייגות מהמשפט הבינלאומי המנהגי.
היום התוודעתי לשיר I me mine של הביטלס (כן, קצת מאוחר). ע"פ וויקיפדיה מה שעומד מאחורי השיר הזה הוא רעיון ביטול האגו והעצמי. שם השיר מורכב מהצורות בהן מתיחסים לאגו בהינדו, כמו למשל בבהגאוואד גיטה פרק 2 מזמור 71.

כשהקשבתי לשיר וקראתי את המילים שלו' נזכרתי שפעם אחד החברים שלי הסביר לי שהשיר "אין אני" מבוסס על רעיון דומה. זה נשמע קצת טריוויאלי היום, אבל פעם חשבתי שזאת סתם מנגינה ולא באמת מילים.
היום כשחיפשתי את השיר "אין אני" בשביל הפוסט קיבלתי בתוצאות החיפוש בגוגל את המשפט של הלל הזקן "אם אין אני לי, מי לי. וכשאני לעצמי, מה אני. ואם לא עכשיו, אימתי". כשלמדתי, דוקטור אבי סגל העלה את המשפט הזה (אם אני זוכר נכון) בכדי לטעון שאומנם מדינה צריכה לדאוג לאינטרסים של עצמה, אך עליה לזכור שהיא לכשעצמה מי היא. היום כאמור כחלק מהחיפוש נתקלתי שוב במשפט וגיליתי שניתן לייחס לו משמעות דיי דומה לזו העולה מהמזמור ההינדי, השיר של הביטלס והשיר של שוטי הנבואה.

The piece of writing (via) which that quote introduces is intellectually substantial, but not all that difficult to read, so you might as well take a look at it yourself. Most of the news media seems to be losing their minds over Wikileaks without actually reading these essays, even though he describes the function and aims of an organization like Wikileaks in pretty straightforward terms. But, to summarize, he begins by describing a state like the US as essentially an authoritarian conspiracy, and then reasons that the practical strategy for combating that conspiracy is to degrade its ability to conspire, to hinder its ability to “think” as a conspiratorial mind. The metaphor of a computing network is mostly implicit, but utterly crucial: he seeks to oppose the power of the state by treating it like a computer and tossing sand in its diodes.
He begins by positing that conspiracy and authoritarianism go hand in hand, arguing that since authoritarianism produces resistance to itself — to the extent that its authoritarianism becomes generally known — it can only continue to exist and function by preventing its intentions (the authorship of its authority?) from being generally known. It inevitably becomes, he argues, a conspiracy:
Authoritarian regimes give rise to forces which oppose them by pushing against the individual and collective will to freedom, truth and self realization. Plans which assist authoritarian rule, once discovered, induce resistance. Hence these plans are concealed by successful authoritarian powers. This is enough to define their behavior as conspiratorial.

היום פורסמה כתבה מעולה באטלנטיק על הפירוק מנשק גרעיני של לוב. שווה לקרוא ולהפנים את החשיבות של שיתוף הפעולה בין האמריקאים לרוסים בעניין המלחמה בתפוצה הגרעינית.
צבא ניקרגואה פלש לשטחה של קוסטה ריקה הוריד את הדגל, החליפו והקים מחנה. עיתון La Nacion, הגדול ביותר בקוסטה ריקה מדווח שהמפקד Eden Pastora השתמש בGoogle maps בכדי להצדיק את הפלישה הצבאית.

Activision הוציאה פרסומת למשחק Call of duty: black ops. הרעיון הכללי של הפרסומת הוא שבכל אחד יש את החייל החבוי בו. אם זאת נשמעת לכם טענה דבילית, זה כנראה בגלל שהיא באמת כזאת. מה שקורה בפועל הוא שבעצם כולם פשוט אוהבים לשחק, זה לפחת מה שיגיד לכם אחד החברים שלי שלמד משחקולוגיה (כן יש דבר כזה).
ואם כבר משחקים אז למה לא ללמוד בדרך. הלומדות היום כבר לא מתעסקות רק בלימוד מקצועות כמו מתמטיקה ושפות, אלא, גולשת גם לתחומים כמו ניהול סכסוכים, התנגדות לא אלימה, זכויות אדם. תפוצה גרעינית ועוד. אותי זה ממש מלהיב לראות נושאים חדשים שמוצגים לילדים באמצעות משחקים ואני רוצה להציג כאן שני משחקים.
המשחק הראשון פותח על-יד הבנק העולמי והוא למעשה רשת חברתית שבה לכל אדם יש אווטאר גיבור-על, עם סיפור כיסוי, חלונות חשמליים וכל מה שבא בחבילה של להיות גיבור-על. בכל יום שלישי (אם אני לא טועה) יוצא קול קורא לכלל משתתפי הרשת החברתית להשתתף בפתרון בעיה דוחקת אחרת בעולם. האתגר מפורסם בצורת קומיקס ובכדי להתגבר עליו יש לעבור מספר שלבים הכוללים: למידה ויישום.בין התרחישים המוצגים במשחק: נפילה כלכלית בקופה הפוסט קומוניסטית, מחסור במזון ביפן, בעיות עקב הצפות בלונדון ועוד. המשחק נקרא EVOKE והוא ממש מוצלח.

המשחק השני הוא A Force More Powerful – הוא כלי ללמוד דרכי התנגדות לא אלימות דרך משחק. המשחק מבוסס על עשרה תרחישים (בעלי ביסוס היסטורי). האסטרטגיות והטקטיקות שהשחקן משחק מפעיל במשחק ייושמו גם הם באירועים אמיתיים. מה עוד חנון יכול לבקש ??
